AN ORDINANCE AMENDING SECTION 7-4-92 OF THE CITY OF CONWAY CODE OF ORDINANCES REGARDING GARAGE SALE PERMITS

 

WHEREAS,     Article G of the Conway Code of Ordinances allows for garage sales within the City Limits of the City of Conway; and

 

WHEREAS,     Conway City Council has determined that it is in the best interest of the City of Conway and its citizens to amend the permit requirements for garage sales and to allow temporary signage for garage sale permitees;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Conway, in

Council duly assembled, that the Conway Code of Ordinances be amended as follows:

 

Section 7, Article G, Garage Sales

Amend:           Section 7-4-92 Permit Required.  It shall be unlawful for anyone to conduct a garage sale on the area described in section 7-4-91 without first obtaining a permit from the city clerk for each sale. The permit shall be posted at the site of the sale. The fee required for such permit shall be as fixed from time to time by the city council. All Conway residents 65 years or older shall be exempt from the fee required for obtaining a garage sale permit provided they reside on the premises of the garage sale.  Exemption from the permit fee does not exempt residents from the permit requirements.  A permit is requited for all garage sales within the city limits of Conway.  The maximum period of each permit is two (2) consecutive days; maximum number of permits allowed per year is four (4) for any one family unit, location, lot or premises. All participants in any joint sale must be named on the permit. (Ord. of 6/25/79) The issuance of a garage sale permit shall entitle those named on the permit to post not more than four (4) signs directing motorists to the location of the garage sale.  These signs may be placed on the permitees property, private property with the written consent of the property owner, or in the public right of way.  Those signs placed in the right of way shall be sited as to not impede driver visibility.  Signs may be posted 48 hours prior to the date of the garage sale and must be removed within 24 hours of the date of the permit.  No sign shall exceed 10 square feet per sign face in size. 

 

BE IT FURTHER ORDAINED, that any part or parts of the Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.
